Collaborative Mediation
Mediation is the private, affordable and effective process by which parties seek to resolve conflict through a professional approach provided by the Mediator. It is an alternative to litigation. If successful, mediation is a solution to conflicts which avoids the significant cost and time of litigation. The Mediator, who guides the process, is neutral and will not favor one side over the other side. Each of the parties explains their point of view and concerns. The Mediator encourages communication by the parties and helps to formulate the issues. The parties collaborate with the Mediator’s guidance to resolve the dispute. In mediation, the parties work together to control and devise a mutually acceptable resolution of the dispute. This process is unlike litigation where a judge or jury is in control and makes a binding decision enforceable against the parties. Confidentiality is also a benefit of mediation.
